1. About these Terms

These Terms of Service & Sale (“Terms”) apply to your access to and use of the websites, online stores, products, checkout, content, customer services and related services operated under the Orbit Trends brand, including orbittrends.com and shop.orbittrends.com (together, the “Services”).

The Services are operated by Innovation Engine Global Pty Ltd, trading as Orbit Trends (“Orbit Trends”, “we”, “us”, “our”). Our business details are set out in our Legal Notice.

By accessing our Services or placing an order, you agree to these Terms, our Privacy Policy, Cookie Policy, Shipping Policy, Returns Policy, and any other policies referenced on our Services.

Nothing in these Terms excludes, restricts or modifies any rights you may have under the Australian Consumer Law or any other consumer protection laws that cannot lawfully be excluded.

2. Eligibility and accounts

You must be at least the age of majority in your place of residence to make a purchase. If you create an account, you are responsible for keeping your login details secure and for all activity under your account.

You must provide complete and accurate information when creating an account or placing an order. We may suspend or cancel accounts that appear fraudulent, abusive, automated, or in breach of these Terms.

3. Product information

We aim to describe products accurately, including images, sizing, materials, pricing and availability. However:

• colours may vary depending on your screen and device settings;
• measurements and sizing information are guides only;
• product availability may change without notice;
• minor variations in packaging, labels or presentation may occur; and
• typographical, pricing or stock errors may occur.

If we discover a material error after you place an order, we may contact you to confirm whether you wish to proceed, or we may cancel the affected item and refund any amount paid for it.

4. Luxury brands and independent reseller status

Orbit Trends sells curated luxury and designer products sourced through legitimate supply channels. Unless expressly stated otherwise, Orbit Trends is an independent retailer/reseller and is not affiliated with, authorised by, sponsored by, or endorsed by any third-party brand owner whose products may be displayed or sold on our Services.

All third-party brand names, logos and trademarks are the property of their respective owners and are used only to identify and describe genuine products.

5. Authenticity

We stand behind the authenticity of products sold by Orbit Trends. Our Authenticity Policy explains our sourcing and review process.

If you believe an item you purchased from us is not authentic, contact us immediately at support@orbittrends.com with your order number and supporting information. If we determine that an item sold by us is not authentic, we will provide a remedy in accordance with applicable law, including a refund where required.

6. Orders and acceptance

When you place an order, you make an offer to purchase the selected products. We may accept or reject an order at our discretion, including where:

• the product is unavailable;
• payment is declined or reversed;
• the order appears fraudulent, suspicious, automated, or for resale;
• shipping to your address is unavailable or unlawful;
• there is a pricing, description or inventory error;
• sanctions, export controls or legal restrictions apply; or
• you have breached these Terms.

Your order is accepted when we send you a dispatch confirmation or otherwise confirm acceptance. An order confirmation email acknowledges receipt but does not necessarily mean the order has been accepted.

7. Pricing, currency, taxes and duties

Prices are displayed in the currency shown at checkout. Unless stated otherwise, prices do not include international customs duties, import taxes, brokerage fees or other charges imposed by authorities outside Australia.

You are responsible for any applicable customs duties, import taxes, tariffs, clearance fees or local charges unless checkout clearly states that duties and taxes are included.

We may change prices at any time before an order is accepted. Promotions, discounts and codes may be subject to separate terms.

8. Payment and fraud checks

Payments are processed by secure third-party payment providers, including Shopify Payments and other providers shown at checkout. We do not store full payment card details.

We may conduct fraud, identity, address, payment and order-verification checks. We may request additional information before processing an order. If verification is not completed, we may cancel and refund the order.

9. Shipping and delivery

Shipping is governed by our Shipping Policy. Delivery timeframes are estimates only unless expressly guaranteed in writing. We are not responsible for delays caused by customs, carriers, payment verification, weather, strikes, force majeure events or incorrect delivery information supplied by you.

Risk in the products passes to you when the products are delivered to your nominated address, except where applicable consumer law provides otherwise.

10. Returns, refunds and exchanges

Returns, refunds and exchanges are governed by our Returns Policy. Your rights under consumer law, including the Australian Consumer Law, apply in addition to any voluntary change-of-mind return policy we offer.

11. Consumer guarantees

For Australian customers, our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these Terms limits those rights.

12. Promotions, sale items and final sale

Sale, promotional or “final sale” labels apply only to voluntary change-of-mind returns. They do not exclude your rights for faulty, misdescribed, unsafe or non-compliant goods under applicable consumer laws.

13. Resale and commercial use

Products are sold for personal, domestic or household use unless we agree otherwise in writing. You must not purchase products for commercial resale, export, marketplace arbitrage, fraudulent activity, or any unlawful purpose.

We may limit purchase quantities, cancel suspected reseller orders, or refuse future service.

14. Sanctions, export controls and restricted countries

You must not use our Services or purchase products in breach of sanctions, export controls, customs rules or other trade restrictions. We may refuse or cancel orders where we reasonably believe fulfillment would breach applicable law or carrier restrictions.

15. Website use

You must not:

• interfere with website security or availability;
• scrape, crawl or copy our content at scale;
• use bots to purchase, reserve or manipulate stock;
• upload malicious code;
• misuse reviews, forms or customer-service channels;
• impersonate another person; or
• use the Services for unlawful purposes.

16. Intellectual property

The Services, website design, text, graphics, images, logos, trade dress, software and content owned by Orbit Trends are protected by intellectual property laws. You may use the Services for personal shopping only. You must not copy, reproduce, distribute, modify or exploit our content without written permission.

Third-party trademarks belong to their respective owners.

17. Reviews, submissions and user content

If you submit reviews, photos, feedback or other content, you grant us a worldwide, royalty-free licence to use, reproduce, edit, publish and display that content for business, marketing and customer-service purposes. You must not submit content that is false, misleading, defamatory, unlawful, infringing, obscene, abusive or harmful.

We may moderate, remove or decline content at our discretion.

18. Third-party services

Our Services may integrate with Shopify, payment providers, shipping carriers, analytics tools, advertising platforms, email providers and other third parties. Their terms and privacy notices may also apply.

We are not responsible for third-party websites or services we do not control.

19. Relationship with Shopify

Orbit Trends is powered by Shopify, which enables us to provide the Services to you. Sales and purchases made through our store are made directly with Innovation Engine Global Pty Ltd trading as Orbit Trends, not with Shopify. To the maximum extent permitted by law, Shopify is not responsible for sales between you and Orbit Trends, including any injury, damage or loss resulting from purchased products or services.

20. Disclaimers

To the maximum extent permitted by law, the Services are provided on an “as available” basis. We do not guarantee that the Services will be uninterrupted, error-free, secure or free of harmful components.

This clause does not affect non-excludable consumer guarantees or statutory rights.

21. Limitation of liability

To the maximum extent permitted by law, Orbit Trends is not liable for indirect, incidental, special, consequential or punitive loss, loss of profits, loss of data, or loss caused by events outside our reasonable control.

Where liability cannot be excluded but can be limited, our liability is limited to the remedies permitted by applicable law, including replacement, repair, resupply or refund.

22. Force majeure

We are not liable for failure or delay caused by events outside our reasonable control, including natural disasters, pandemics, strikes, carrier disruption, customs delays, supplier failure, cyber incidents, war, terrorism, government action or platform outages.

Our handling of personal information is described in our Privacy Policy and Cookie Policy.

24. Changes to these Terms

We may update these Terms from time to time. The version published when your order is accepted applies to that order. Continued use of the Services after changes means you accept the updated Terms.

25. Governing law

These Terms are governed by the laws of New South Wales, Australia, unless mandatory consumer laws in your country or region require otherwise. You and Orbit Trends submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia.
